過払い請求は利息を計算し直すことで生じた過払い金の返還を請求するものです。まず、借金の金額×利息＝１年分の利息、１年分の利息÷３６５(日) ＝１日分の利息を計算してから、１日分の利息×借りている日数＝発生する利息を計算します。
例えば、１００万円を２９．２％の利息で３０日借りたなら、１年分の利息は、１００万円×２９．２％＝２９２,０００円、１日分の利息は２９２,０００円÷３６５(日)＝８００円となります。これに借りた30日をかけて、８００円×３０日＝２４,０００円が発生する利息になります。そして、３０日後に３万円返したなら、３０,０００円－２４,０００円＝６,０００円が元金の返済に充てられます。１００万円－６,０００円＝９９万４,０００円が返済後の借金の総額です。
